1. Acceptance of Terms
By accessing, browsing, or using the JobHunting.co.za website and services (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue your use of the Platform immediately.
These Terms constitute a legally binding agreement between you and JobHunting Digital (Pty) Ltd ("JobHunting," "we," "us," "our"), a company registered in South Africa.
2. Who We Are
JobHunting.co.za is an online job search and career resources platform operated by JobHunting Digital (Pty) Ltd, registered in South Africa. Our platform connects South African job seekers with employers, provides career guidance content, and facilitates job applications. We are not a recruitment agency and do not act as an employer or agent for any employer listed on our Platform.
3. Use of Our Platform
You may use our Platform only for lawful purposes and in accordance with these Terms. Our Platform is intended for use by individuals who are 18 years of age or older. By using our Platform, you represent and warrant that you meet this age requirement.
You agree to use the Platform only in a manner that:
- Complies with all applicable South African laws and regulations, including the Labour Relations Act (LRA), Basic Conditions of Employment Act (BCEA), and Protection of Personal Information Act (POPIA);
- Does not violate the rights of any other person or entity;
- Is not for any fraudulent, deceptive, or harmful purpose.
4. User Accounts
Some features of our Platform require you to create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorised access to or use of your account by contacting us at hello@jobhunting.co.za. We are not liable for any losses resulting from unauthorised use of your account due to your failure to safeguard your credentials.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 24 months.
5. Job Seeker Terms
As a job seeker, you agree that:
- The information you provide on your profile and in job applications (including your CV) is accurate, truthful, and current;
- You will not misrepresent your qualifications, experience, skills, or identity;
- You understand that we do not guarantee employment or the accuracy of any job listing, salary information, or employer description;
- We are not responsible for the conduct, promises, or decisions of any employer on our Platform;
- You will conduct your own due diligence on any employer before accepting employment, sharing sensitive personal or financial information, or making any payments;
- Legitimate employers will never ask you to pay a fee to apply for or be considered for a job — if you encounter this, it may be a scam and you should report it to us immediately.
6. Employer and Recruiter Terms
Employers and recruiters who post job listings agree that:
- All job postings are for genuine, current vacancies that comply with South African employment law, including the Employment Equity Act (EEA) and Labour Relations Act;
- All advertised roles and their requirements, including BEE/EE requirements, are accurately described;
- Salary information provided is accurate and reflects the genuine remuneration on offer;
- You will not post discriminatory, misleading, or fraudulent job listings;
- You are responsible for all candidate communications and hiring decisions;
- Job seeker personal information obtained through our Platform will only be used for legitimate recruitment purposes and in compliance with POPIA.
7. Content and Intellectual Property
All content on JobHunting.co.za, including text, graphics, logos, career articles, guides, images, and the site design ("Content"), is the intellectual property of JobHunting Digital (Pty) Ltd or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.
You may access and use the Content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, display, or create derivative works from any Content without our express prior written consent. Employer job postings remain the intellectual property of the respective employer.
By submitting content to our Platform (such as CVs or employer job descriptions), you grant JobHunting a non-exclusive, royalty-free licence to use, display, and process that content for the purpose of providing our services.
8. Prohibited Conduct
You agree not to engage in any of the following on or in connection with our Platform:
- Posting false, fraudulent, misleading, or spam job listings;
- Scraping, crawling, or harvesting data from our Platform without express written permission;
- Attempting to gain unauthorised access to any part of our systems or other users' accounts;
- Uploading or transmitting malware, viruses, or any other malicious code;
- Harassing, threatening, or abusing other users;
- Impersonating any person, company, or organisation;
- Using our Platform to solicit personal or financial information from other users for non-recruitment purposes;
- Violating any applicable South African or international law or regulation.
We reserve the right to remove any content and terminate the accounts of users who violate these prohibitions.
9. Advertising (Google AdSense)
JobHunting.co.za displays third-party advertisements through Google AdSense. By using our Platform, you acknowledge and agree that:
- Advertisements on our Platform are served by Google LLC and are subject to Google's Privacy Policy;
- Google may use cookies and similar technologies to serve personalised ads based on your browsing history;
- We do not endorse and are not responsible for any advertised products, services, or websites;
- You may opt out of personalised advertising through Google's Ad Settings.
10. Disclaimer of Warranties
Our Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by South African law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Platform will be uninterrupted, error-free, or free from viruses or other harmful components;
- Any job listings are accurate, complete, current, or that any position will be filled;
- Using the Platform will result in employment or any particular career outcome.
11. Limitation of Liability
To the maximum extent permitted by South African law, JobHunting Digital (Pty) Ltd and its directors, employees, and partners will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our Platform. Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed R1,000 (one thousand rand) or the amount paid by you to us in the 12 months preceding the claim, whichever is less.
12. Indemnification
You agree to indemnify and hold harmless JobHunting Digital (Pty) Ltd and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, your use of the Platform, or your violation of any applicable law or the rights of any third party.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa. You consent to the jurisdiction of the Gauteng Division of the High Court of South Africa for any such disputes.
14. Changes to These Terms
We may amend these Terms from time to time. We will notify registered users of material changes by email and/or by displaying a prominent notice on the Platform. The updated Terms will become effective on the date indicated in the "Last updated" notice. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
